Investor’s rights and obligations

An application to participate in the public tender for land purchase requires that all Bidders pay a deposit amounting to 20% of the initial land purchase price.
A preferential land purchase price for a specific land plot or a larger number of land plots will be allocated to an investor who offers a higher price, and if more than one investor offer the same price, priority shall be given to the investor whose offer is received by the City of Varaždin earlier. In the event of a single bid being submitted for a given land plot or more land plots, such a bid shall be accepted, provided that the bid price is at or above the initial price.
The selected Bidder shall, within 15 days of a decision being made on the most favourable Bid, conclude a Land Sales Contract and pay the remaining outstanding balance i.e. the land plot price reduced by the paid deposit.

In the event that a selected Bidder withdraws before a land sale contract is concluded or if the remaining balance of a preferential price remains unpaid, such a bidder shall be excluded from further procedure and lose the right to reimbursement of the deposit in addition to any funds which have been paid to the City of Varaždin.
An investor awarded subsidies such as the preferential rate of land purchase, a reduction of utility contribution, a reduction of utility fee, a meeting of the costs of land conversion shall not sell the property or any of its parts, through any legal transaction in the period of seven (7) years from conclusion of the Sales Agreement.
An investor is prohibited from establishing a lien on the property to the benefit of third parties through any legal transaction (i.e. by establishing a right of construction, lien, easements or any other burden).
This prohibition of sale and liens on the property shall be registered in the land registry of the competent court for a period of 7 years.
